This Agreement is between you and NATION Driving School hereby referred to as “NATION”. BY ACCEPTING THESE TERMS AND CONDITIONS YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO ALL OF THE BINDING TERMS OF THIS AGREEMENT. You also acknowledge

 

That I(you) are the parent or legal guardian of the student or that you are at least 15 years of age. Parental Consent: The parent/guardian of the student hereby agrees to allow their chil(ern) son/daughter to take part in one-on-one driving lessons with a certified NATION Driving School Driving Coach and to partake in all of the mandatory curriculum and courses that correspond with the program in which the student is enrolled. Our driving session is a one on one lesson educational program we do not or hold any group driving session lessons.

 

Welcome to NATION Driving School. We are a recognized state-wide for its value and commitment to safety by completing any of our Programs gives you the benefit and knowledge of our over 20 years’ experience in Drivers Ed program. Our hands-on, behind-the-wheel driving programs teaches new and beginner drivers Basic Driving Techniques to Advanced Driving Techniques. All our Instructors are Certified Driving Instructors, also experienced Public Safety Professionals, who are licensed and certified in Advanced Driving Techniques. Together with our advanced driver training and professional experience, our students will learn to drive a motor vehicle safely, responsibly & defensively. Our program exceeds the high school driver education curriculum.

 

Paperwork: All paperwork must be filled out using the true legal name of the student that matches the student’s Learner’s Permit. Please have Learner’s Permit available on the first lesson for the Driving Coach to see. All paperwork must be filled out prior to a student beginning their program. Paperwork can be mailed, faxed, e-mailed or physically dropped off to NATION Driving School and must be received any time before lessons begin.

 

Learner’s permit: A student who holds a learner’s permit must have the original learner’s permit (photocopy is not permitted) with them upon registration and is required for all behind-the wheel lessons or else the lesson will be forfeited and the no-show fee will be charged to the student. The student must have his/her learners permit before he/she can participate in his/her student license phase behind-the-wheel lessons.

 

Changing a pick-up/drop-off location: The student may change their pick-up and drop-off location for a behind-the-wheel lesson, but it must be within NATION Driving School geographical limitations, and must be approved 24 hours before their behind-the-wheel lesson. Parental consent must also be provided before the lesson commences. NATION Driving School has the right, within its sole discretion, to deny any new pick up/drop off location

 

Lesson reschedule Policy: All behind-the-wheel lesson reschedule must be received in excess of 7 days before the scheduled lesson start time. Reschedule made less than 7 days of lesson start time will be assessed a cancelled lesson or No Show fee of $125 for each lesson or for each day which must be paid before student can reschedule the cancelled lesson and progress in the program. This driving school will not refund any tuition or part of tuition if school is ready, willing and able to fulfill its part of this contract. Appointments must be rescheduled 7 days in advance to avoid forfeiture of a lesson. You agree and it is understood to you that upon the signing of this contract all lessons and instruction must be completed within 60 days once you pass the 60 days period all driving lesson terms and any agreement will be consider as expire and terminated at that time and no refund will be issued.

 

Guarantee or Warranty: NATION Driving School, Driving lessons is a service to teach you or anyone who desire and agree to take classes and wants to learn how to drive and take our driving lesson classes. We will effectively teach, coach you in the knowledge & skills you need to know and to become a safe driver. You must practice the techniques and the knowledge you gain from NATION Driving School. NATION Driving School is not liable & or held responsible if a student fails there written test, vision test or driving test. NATION Driving School does not promise, warrant and/or guarantee that any of its students will pass his/her DMV written test or DMV/ third party drive test or that they will not get into any automobile crashes while taking part in any behind-the-wheel training courses and programs. Learning, completing and passing the driving test is the ability & student sole responsibility of the student. We are a driver driving learning school we provide the behind-the-wheel training you need to know to drive.

 

One of our main goal is “Teens Behind-the-Wheel Awareness” keeping teens and their friends safe and aware while they're behind the wheel. Key takeaway: put the phone down. Keep their hands on the wheel and their eyes on the road. If teens need to send a text, they should look to their co-pilot do it for them, or wait until they've stopped their car.

Our dedicated Instructors and our customer services representatives will be with you every step of the way to ensure you not only obtain the driving experience you deserve, but also are one step closer to passing your driving test on the first try and becoming a safe defensive driver. Our commitment to developing safe driver’s, starts by providing the best driving lesson available. All our instructors are experienced and go through a rigorous certification process. Our vehicles are all newer models and continually inspected to ensure they meet our standards of excellence.

 

If the Instructor determines the student is ready for the DMV Test, part of the hours included in the package can be used to take the DMV test in our car. Includes pick up and drop off the day of the scheduled appointment. This driving school will not refund any tuition or part of tuition if school is ready, willing and able to fulfill its part of this contract. Appointments must be rescheduled 7 days in advance to avoid forfeiture of a lesson. Payments and reschedule: I agree to pay and I agree my credit card will be charge automatically or any other form of payment will be charge and I agree to pay for the class or course. I agree and understand there is a 3.5% processing fee for all credit card payments I agree to pay this fee. I understand that all Driving Lessons, classes, Courses must be reschedule 7 days of the lesson start time and if I fail to do so my Driving Lessons, classes, Courses is (are) there will be no money refund.

 

Return Check Policy: The return of a check or bounce of a check because of nonsufficient funds, or NSF (electronic or paper) issued to the NATION Driving School will result in a $75.00 returned check fee/ bounce check fee addition to the total due, being placed on the account of the student or the individual whose behalf the check was presented for each returned check, no matter the reason.

Each account will only be allowed one returned checks after which payment by check will not be accepted. This includes returned electronic payments. Written notification on how to resolve the returned check will be sent to the maker of the check, and to the person whose account was affected. A hold will be placed on the account affected, until the returned check has been redeemed.

If the returned check has not been redeemed within the stated time frame on the notification, a late fee of $150 with the total past-due amount. Important Note: A returned check may automatically result in a hold on the account affected, which may preclude participation in any or all of the following activities: Driving Lessons, Road Test and Issuing of the Certificate.

 

Late reschedule and No-Show Fee: If a student does not show up to his/her behind-the-wheel lesson, he/she will be considered a no-show and will be assessed a $125 no-show fee. If a student does not show up to his/her observation lesson, he/she will be considered a no-show and will be assessed a $125 no-show fee. Driving Coaches will wait 20 minutes before considering the student a no-show at behind-the-wheel lessons. After the Driving Coach has waited 20 minutes, and has tried unsuccessfully to contact the student via telephone, they will leave the pick-up site, and the no-show fee must be paid before student can reschedule the missed lesson and progress in the program.

 

Student’s Physical and Mental Condition: It is the responsibility of the student and/or his/her parent/guardian(s) to notify NATION Driving School if there are any physical, mental or other conditions that can affect the student’s ability to drive safely. The student/parent/guardian must notify NATION Driving School if there is any kind of medication that can affect the student’s ability to drive safely. It is similarly the student and parent/guardian’s responsibility to check if any medications affect the student’s driving abilities.

 

Parents of students with learning disabilities are required to disclose these conditions and share student’s Individual Learning Plan with NATION Driving School prior to start of behind-the-wheel lessons to contribute to the safety of both student and Driving Coach.

 

Behavior: The student must, at all times, act in a mature, respectful and appropriate manner during behind-the-wheel lessons, classroom sessions and/or workshops. Any behavior the Driving Coach and NATION Driving School deems inappropriate and/or disruptive to the learning process can result in student expulsion. In the case of an expulsion, no refunds will be given. The Undersigned represents that student will not be at the time of participation in the Program under the influence of alcohol, illegal substances, or any other intoxicants or legal drugs which might induce sleepiness, nervousness, or other condition which could adversely affect his/her ability to drive an automobile or understand and comply with oral or written directions regarding the use of an automobile.

 

We are the sole owners of the information collected on NATION Driving School website. We only have access to collect information that you voluntarily give us via email or other direct contact from you.  We will not share, sell or rent this information to anyone. We will use your information to respond to you, regarding the reason you requested or contacted us.  We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to ship an order. Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy. You may opt out of any future contacts from us at any time.  You can request us to change/correct or delete any data we have about you at any time by contacting us via the email address or phone number given on our website.

 

NATION Driving School is not responsible for delays or the termination of service in caused by weather or unsafe road conditions. Company is not liable for any damage or inconvenience caused by a delay or failure to provide Class/ Course or any service. In the event that we are unable to provide the Class/ Course as you requested or schedule, our liability is limited to the reserve date or time. Services and Vehicles pictured on our website are for advertising purposes only. Actual classrooms, instructors may be different from our website photos also vehicle may be different in size, color, make, model, and design from website photos. In the event that we are unable to provide the exact vehicle that you requested, we reserve the right to provide an alternative vehicle at our discretion. If any rules or laws have been broken during the performance of in the service by you with us, all future services classes or courses will be terminated without any prior notice to the student/ client and you may lose your deposit.

 

We take precautions to protect your information.  When you submit sensitive information via the website, your information is protected both online when you register and offline when we receive. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way.  You can verify this by looking for a closed lock icon at the top or bottom of your web browser, or looking for "https" at the beginning of the address of the web page.

 

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information.  The computers/servers in which we store personally identifiable information are kept in a secure environment. Some of our business partners may use cookies on our site (for example, advertisers). However, we have no access to or control over these cookies. We partner with another party to provide specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services.

Release and Waiver: The student and his/her parent/guardian hereby release, waive, and discharge all claims and potential claims against, and covenants not to sue NATION Driving School, its parent, subsidiaries, affiliated entities, officers, employees, agents and facilities with respect to any damages, illness, injuries, death or losses of any kind to the student or any vehicle or any property damage or loss to any other party arising in connection with the student’s enrollment and participation in the NATION Driving School curriculum, programs and training sessions and the student’s operation of any NATION Driving School vehicles.

 

Assumption of the Risk and Waiver of Liability Relating to contagious Virus or diseases
 

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend many guidelines to stay healthy examples are social distancing and have, in many locations, prohibited the congregation of groups of people.
 

Nation Driving School has put in place preventative measures to reduce the spread of COVID-19; however, the Nation Driving School cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Nation Driving School may or may not increase your risk and your child(ren)’s risk of contracting COVID-19.
 

By agree to this agreement, I(you) acknowledge the contagious nature of physical illness of any kind or infected by any virus, bacteria or any types or contagious diseases such as COVID-19 and voluntarily assume the risk that my(your) child(ren) and I(you) may be exposed to or infected by COVID-19 by attending the Nation Driving School and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I(you) understand that the risk of becoming exposed to or infected by COVID-19 at the Nation Driving School may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Nation Driving School employees, volunteers, and program participants and their families.
 

I(you) voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my(your) child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Nation Driving School or participation in Nation Driving School programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Nation Driving School, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Nation Driving School, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any  Nation Driving School program.
 

ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, including by way of example and not limitation, any risks that may arise from error, negligence or carelessness on the part of the persons, driver, anyone else or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

 

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the NATION Driving School event holders, sponsors, and organizers of the driving lessons activity in which I may participate, and that it will govern my actions and responsibilities at said activity. In consideration of myself permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

 

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, or actions of any kind which may hereafter occur to me including my traveling to and from this activity.

 

(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

 

(C) PRIVACY, CONFIDENTIALITY AND NON-DISCLOSURE AGREEMENT: The Parties shall (i) use reasonable efforts to maintain the confidentiality of the information and materials, whether oral, written or in any form whatsoever, of the other that may be reasonably understood, from legends, the nature of such information itself and/or the circumstances of such information’s disclosure, to be confidential and/or proprietary thereto or to third parties to which either of them owes a duty of nondisclosure (collectively, “Confidential Information”); (ii) take reasonable action in connection therewith, including without limitation at least the action that each takes to protect the confidentiality of its comparable proprietary assets; (iii) to the extent within their respective possession and/or control, upon termination of this Agreement for any reason, immediately return to the provider thereof all Confidential Information not licensed or authorized to be used or enjoyed after termination or expiration hereof, and (iv) with respect to any person to which disclosure is contemplated, require such person to execute an agreement providing for the treatment of Confidential Information set forth in clauses (i) through (iii). The foregoing shall not require separate written agreements with employees and agents already subject to written agreements substantially conforming to the requirements of this Section nor with legal counsel, certified public accountants, or other professional advisers under a professional obligation to maintain the confidences of clients.

 

I acknowledge that NATION Driving School, Inc. and their directors, officers, instructors, representatives, students and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. I acknowledge that this activity may involve a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, and actions of other people including, but not limited to, participants of the activity. I hereby consent to be responsible myself for all expenses to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity. I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns. The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT
